Marimar Martinez, who survived being shot by a U.S. Customs and Border Protection agent last year, testified at a congressional forum Tuesday on use of force by federal immigration agents.
Martinez detailed her experience, including how evidence later contradicted the agent’s narrative on what happened.
“I'm born and raised in Chicago, Illinois, where I learned the values of resilience, community, respect, love and hope,” she said. “On Oct. 4, 2025, those values were tested when my life was nearly taken by my own government.”
In the high-profile case, a Border Patrol agent shot the U.S citizen and first-generation Mexican American five times during an immigration enforcement operation, dubbed “Operation Midway Blitz,” in Chicago. Federal prosecutors accused Martinez of ramming her vehicle into an agent before the shots rang out. A judge later dismissed the criminal charges after evidence challenged the government’s claim that it was a “defensive” shooting.
Martinez's lawyer is now pushing for evidence in the case to be released to show how DHS responds when "their agents use deadly force against U.S. citizens."
“How many more lives must be lost before meaningful action is taken?” Martinez said.
Federal immigration agents have been involved in more than a dozen shootings, some fatal, since President Donald Trump began his second term, sparking public outcry over use of force by officers deployed as part of his immigration crackdown.
Families of victims and residents of Minneapolis, where two fatal shootings occurred last month, have demanded more transparency and accountability from the government, which has tried to shut local and state law enforcement out of investigations into the deaths.
The issue became a driving factor behind the partial government shutdown this week. Democrats refused to agree to a government funding deal for a handful of agencies, including the Department of Homeland Security, without reforms to ICE and U.S. Customs and Border Protection, including requiring agents to wear body cameras, refrain from obscuring their faces and obtain judicial warrants for arrests. Lawmakers approved a short-term measure Tuesday that funds DHS only through Feb. 13, while debate continues over these proposals.

Aliya Rahman is arrested by ICE agents in Minneapolis on Tuesday. The U.S. citizen says she was headed to a medical appointment when agents hauled her from her car. (Adam Gray/The Associated Press)
Photo from a NY post article smearing the victim of the lawless violence. Right wing Americans and media justify murders too. Suddenly carrying a gun legally justified an execution. What is wrong with these people?
She is especially concerned that the torture of others in the detention center be exposed.
She is a US Citizens who was cruelly and brutally ripped from her car after becoming ensnared in a traffic jam produced by violent DHS agents. They tortured her, detained her illegally, denied her rights to lawyer, phone call, to medical care, and used cruel and unusual punishment for THEIR chaos on the streets. They mocked her and used slurs against asian people.
Here is part of the transcript of her testimony. THANK YOU to all the brave witnesses.
RENEE GOOD< ALEX PRETTI< KEITH PORTER<GERALDO CAMPOS< SILVERIO VILLEGAS_GONZALES and tens of others could not testify because their lives has been taken by the president's cruel, violent, and lawless army of thugs.
PLEASE CALL FEDERAL LAWMAKERS AND DEMAND DHS BE disbanded, held accountable, removal of MILLER, REMOVE NOEM< REMOVE< HOMAN for bribery etc etc NOW.
Investigate and convict, and punish them for their crimes against humanity, torture and murder.
NEW laws must be enacted NOW to remove masks, add name plates, remove agents with any allegation of violence, investigate and convict, and punish them.
5calls provides scripts. So does Resistbot.
I received no medical screening, phone call, or access to a lawyer. I was denied a communication navigator when my speech began to slur Asians laughed as I tried to immobilize my own neck I asked for my cane and was told no, pulled up by my arms and prodded forward and leg irons by agents laughing and saying, walk, you can do it, walk. Agents did not know if the facility had a wheelchair. When I was finally placed in one to be taken to interrogation, an agent taunted you were driving, right? So your legs do work. I pleaded for emergency medical care for over an hour after my vision had become blurry, my heart rate went through the roof and the pain in my neck and head became unbearable. It was denied when I became unable to speak, my cellmate pleaded for me. The last sounds I remember before I blacked out on the cell floor where my cellmate banging on the door, pleading for a medic and a voice outside saying, we don't want to step on ISI's toes. When I opened my eyes at Hennepin County's emergency room, I learned I was brought there to be treated for assault.
The impacts of DHS detention on my physical, mental, and financial well-being and safety have been very severe, but I do not deserve more humane treatment than anyone else US citizen or not.
And I am here today with a strong spirit. and a duty to the many people who haven't had the privilege to tell their stories or see their loved ones come home.
I am extremely distressed by the pattern that violence from [TRUMP-Miller-Noem-Bovino's violent and lawless DHS] law enforcement has been happening to black and indigenous communities for centuries.
And to DHS survivors for over 20 years. We call ourselves a civilized nation, but we lack rules and accountability around what a person claiming to be law enforcement is permitted to do to another human being.
I am not afraid, and I'm not afraid to keep working on this problem even after ICE is gone.
Thank you for your time

Aliya Rahman, a Minneapolis resident who was detained by immigration agents in January, described her experience to lawmakers at a congressional forum Tuesday, saying she was dragged from her car and denied medical care despite having a disability.
Rahman said that after Immigration and Customs Enforcement agents broke her car window, shattering glass over her body, they used a knife to cut her seatbelt off and forcibly removed her from her car. She said she was taken to a detention facility, where she was denied the use of her cane. Despite asking for medical treatment and access to a lawyer, she was held in an interrogation room until she blacked out.
Rahman spoke at a public forum held Tuesday by Congressional Democrats to examine the Department of Homeland Security’s use of what they say is excessive force.

On February 3, 2026, House and Senate Democrats held a bicameral public forum to examine alleged violent, high-force tactics used by Department of Homeland Security (DHS) agents, specifically Immigration and Customs Enforcement (ICE) and Customs and Border Protection (CBP), under the Trump administration. No officials from the DHS appeared at this forum. [1, 2, 3]
Below is the summary of the testimonies and analysis based on the February 3, 2026 proceedings.
Key Testimonies (Feb 3, 2026)
The forum featured testimony from civilians and family members affected by recent immigration enforcement actions:
Renee Good’s Brothers (Luke and Brent Ganger): Delivered emotional testimony regarding the fatal shooting of their sister, a 37-year-old mother of three, by federal immigration agents in Minneapolis in January 2026. They testified that despite bipartisan backlash, little has changed, and expressed "deep distress" over the violent nature of her death.
Marimar Martinez: A U.S. citizen from Chicago who testified that she was shot five times by CBP agents in October 2025. She stated that she was charged with assaulting the agents, but all charges were dropped six weeks later.
Aliya Rahman: A Minneapolis resident who testified that she was dragged out of her car by immigration agents.
Context: The forum was held by Sen. Richard Blumenthal (D-CT) and Rep. Robert Garcia (D-CA) as part of an ongoing inquiry into what they termed "lawless and abusive" tactics by federal immigration agents.
Demands for Accountability: Lawmakers, including Rep. Raja Krishnamoorthi, demanded the firing of specific officials, citing testimonies that DHS officials advanced false narratives after violent encounters.
Legislative Demands: Rep. Hakeem Jeffries outlined demands for changes, including a prohibition on ICE detaining U.S. citizens, requirements for body cameras, and prohibitions on agents wearing masks.
DHS Response: While no officials appeared at the forum, on the same day, DHS released data highlighting a 3,300% increase in vehicle attacks against ICE law enforcement from Jan 2025 to Jan 2026, framing their actions as necessary to arrest "murderers, pedophiles, rapists, gang members, and terrorists". [1, 10, 11, 12, 13]

Homeland Security is targeting Americans with this secretive legal weapon
Under Trump, the Department of Homeland Security has weaponized administrative subpoenas to attack free speech, according to privacy and civil rights groups.
wapo.st
https://wapo.st/4rtfCw8. Please bring these kinds of violations up in your calls to lawmakers this week. Surveillance and intimidation of citizens is bulldozing the Bill of Rights, and an enormous violation of our free speech right. The Don Lemon and Georgia Fort arrest is twisting a law intended to protect women from anti abortion protesters. No judge is involved. DHS must be disbanded and laws allowing their tactics removed asap.
Recent reports and investigations indicate that high-level officials within the Department of Homeland Security (DHS) and affiliated agencies, particularly during the Trump administration's second term (beginning Jan 2025), have labeled individuals who were victims of violence at the hands of immigration agents or involved in protests as "domestic terrorists".
These accusations are often made swiftly following incidents, sometimes contradicted by video evidence, and are part of a broader, documented pattern of using the "terrorist" label to describe political opponents, protesters, and immigration activists.
Examples of DHS Labeling Victims as "Domestic Terrorists"
Incident/Individual
Context & Accusation
Contradicting Evidence/Outcome
Alex Pretti (Jan 2026)
Shot and killed by ICE agents in Minneapolis. DHS officials labeled him a "domestic terrorist" claiming he intended to "massacre" officers.
Bystander video and witness testimony showed Pretti was holding only a phone, not resisting, and was shot in the back while trying to help a woman.
Renee Good (Jan 2026)
Killed by ICE agents in Minneapolis. Secretary Noem/DHS immediately labeled her a "domestic terrorist".
Reports indicate she was a victim of excessive force by agents during a confrontation.
"Martinez" (Jan 2026)
Survived a shooting by federal agents. DHS issued a press release calling her a "domestic terrorist".
Federal prosecutors dropped all charges against her.
Protesters (Various) (2017–2026)
Individuals organizing against police violence or immigration crackdowns (e.g., "Cop City" in Atlanta, 2023) described as "violent extremists".
Critics argue this criminalizes First Amendment-protected activity and protesters.
Ramon Morales Reyes (May 2025)
Detained by ICE based on a framed, forged threat. DHS and White House accused him of trying to kill the President.
Investigations showed the threat was fabricated by his assailant to get him deported; charges were dismissed.
Key Findings on DHS Usage of "Domestic Terrorism" Label
Swift Labeling: Officials have been documented using the label before investigations are completed, particularly in cases involving immigration enforcement shootings.
Contradicted Evidence: In multiple instances, video evidence, witness testimony, and the dropping of charges have contradicted the "domestic terrorist" label applied by DHS officials.
Ideological Targeting: Critics, including the ACLU, argue this is a pattern of using "DVE-related language" to stigmatize activists, protesters, and, in some cases, people who have been victims of excessive force.
Official Policy: The usage of such language is often aligned with directives aimed at "countering domestic terrorism and organized political violence".
Note: The results reflect information up to early 2026.
